As MindioMobile (hereinafter referred to as the “Company”), we attach great importance to the protection of your personal data and private information. Therefore, as the Data Controller, we demonstrate all necessary effort and care to ensure that your personal data is processed, recorded, stored, updated, transferred, and/or classified in accordance with the Law on the Protection of Personal Data No. 6698 (“KVKK Law”) in connection with our business purposes and within the framework explained below. We fulfill our disclosure obligation as the “Data Controller” through this “Privacy Policy” and “Clarification Text”.
In this context, pursuant to the Laws and Regulations organized to protect your fundamental rights and freedoms, particularly the privacy of private life, and to protect your personal data, all technical and administrative measures are taken by our Company to ensure the appropriate level of security in order to prevent unlawful processing of your data, to prevent unlawful access to your data, and to ensure the preservation of your data.
This text has been prepared to inform all real persons, including visitors to our website, participants in our events, speakers and presenters participating in our events, persons representing our solution partners and suppliers with whom we work to carry out our business, and representatives of organizations participating in or sponsoring our events.
Personal information recorded during the visit to our website (www.MindioMobile.com) is processed in accordance with the legislation on the protection of personal data. Please review our Privacy Policy, which can also be found on our page regarding this matter. We must state that we do not provide a guarantee regarding the data security level and measures of other websites and data-processing organizations linked on our site. The data security policy of the relevant organization and site should be carefully examined in this regard.
1. Why Do We Inform You? (Legal Nature and Scope) Pursuant to Article 10 of the KVKK Law titled “Obligation of the Data Controller to Inform”, we are required to inform data subjects before obtaining explicit consent to process personal data.
Within the scope of the KVKK Law, personal data refers to any information relating to an identified or identifiable natural person (“Personal Data”); and Special Categories of Personal Data (Sensitive Data), which is a special type thereof, refers to your data regarding race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, appearance and dress, membership of associations, foundations or trade unions, health, sexual life, criminal conviction and security measures, and your biometric and genetic data (“Special Categories of Personal Data”). As per our business model, strictly as MindioMobile, we take care not to process your special categories of personal data. Special categories of personal data that you may share in writing or verbally with other participants during digital and physical events and outside of our knowledge are your own responsibility.
Pursuant to Article 3/1-ı of the KVKK Law, MindioMobile is a “Data Controller”. As required by law, within the scope of the obligation to inform as a data controller, we are obliged to inform you, the data subjects, about our identity, the purposes for which we process your personal data, the persons to whom we transfer your personal data and our purposes for transferring, the legal reasons for collecting your personal data, to whom we may transfer it and our transfer methods, and your rights listed in Article 11 of the KVKK Law, such as updating, deletion or anonymization, which you may direct to us as the data subject. With this clarification text, we aim to inform and enlighten you, the relevant persons, within the legal limits and conditions stated above.
2. Who Are We as Data Controller? In Article 3, Paragraph 1, Clause (ı) of the KVKK Law, the data controller is defined as “Real or legal persons who determine the purposes and means of processing personal data and are responsible for the establishment and management of the data recording system”. In this context, the data controller is MindioMobile, whose websites listed above you visit.
3. For What Purposes Do We Process Your Personal Data? Your personal data is processed in line with the principles in the KVKK Law for the purposes of: a) Enabling you to participate in our events as a person or organization, b) Being informed about products and services and benefiting better from these services, c) Increasing the quality of the services we offer, d) Customizing our services according to your needs, expectations, and usage habits, e) Correct planning and execution of our commercial partnerships and strategies, f) Enabling you to purchase tickets to attend events, g) Enabling you to become a member of our online services, h) Enabling you to manage the account you opened for participation in digital events, i) Verifying your identity as a participant and user, j) Ensuring the legal, commercial, and physical security of our Company and business partners; k) Taking precautions to ensure personal and commercial data security, using appropriate IT infrastructure and databases, and taking administrative and technical measures, l) Improving the services offered on our site, responding to future requests and complaints, and eliminating errors occurring in this medium, m) Ensuring our Site’s compliance with our Privacy Policy, n) Carrying out the necessary work by our relevant business units to realize our commercial activities and carrying out the related business processes, o) Determining business strategies and ensuring our corporate functioning in line with our strategic plans and goals, within the scope of the personal data processing conditions specified in Articles 5 and 6 of the KVKK.
4. Principles We Adhere to While Processing Your Personal Data As MindioMobile; the principles we adopt in the processing of personal data are as follows; a) Processing in compliance with the law and honesty rules, b) Striving to ensure accuracy and currency, c) Processing for specific, clear, and legitimate purposes, d) Being connected, limited, and proportionate to the purpose for which they are processed, e) Being strictly strictly retained for the period foreseen in the relevant legislation or required for the purpose for which they are processed.
5. On What Legal Grounds Do We Process Your Personal Data? Your data is kept and processed at MindioMobile in the presence of your explicit consent or one of the conditions of compliance with the Law. In the presence of one or more of the following conditions, your explicit consent is not required for the processing of your data. a) Cases explicitly stipulated in laws (personnel file, invoice transactions, etc.) b) Processes directly related to the establishment or performance of a contract (contract, letter of consent, etc.) c) Being made public by the person concerned (unilateral sharing, business card, social networks, etc.) d) Legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the person concerned.
6. Which Personal Data Do We Process? Your personal data may be processed in written, verbal, or electronic media via automatic or non-automatic methods, registration at the event area, registration via the website, and similar means, in accordance with Articles 4, 5, and 6 of the KVKK Law.
a. Personal Data of Participants: Participants share information such as name, surname, e-mail, telephone, company name, title, etc. with us by filling out the forms on our site in order to register for events. MindioMobile physical and digital events are networking events where professionals, entrepreneurs, organizations, and leading institutions in the sector participate to meet other actors. Your “explicit consent” will be sought regarding your personal data provided for registration purposes. We would like to state that due to this requirement, which is important for security and identity verification, you cannot register for events if you do not give “explicit consent”. You may request the suspension of processing and deletion of your data if you leave the event while it is ongoing or after the event is completed. For participants attending paid events, information such as the person’s name, surname, credit card number, credit card expiration date, and credit card security code will be processed so that they can purchase tickets. The payment transaction is carried out automatically through the bank and the organization providing the POS service, and it is not in question for us as MindioMobile to process and record this data. Our digital events are conducted over the internet using the Hubilo infrastructure. During the digital event, which is designed similarly to a real physical event, in addition to those listed above and as a requirement of the technical infrastructure used, your video and still images, voices, and written communication records made through the system are processed but not recorded. We would like to state that we do not record video, audio, or written communications you make among yourselves as participants and organizations within the scope of the events in any way.
b. Personal Data of Those Filling Out Contact Forms: We process personal data such as name, surname, e-mail, telephone, company name, and title of those who wish to communicate using the forms on our site.
c. Personal Data of Organization Representatives: MindioMobile processes a minimum level of personal data belonging to real person suppliers, supplier employees and/or supplier officials, and representatives and officials of customer organizations for the purpose of tracking and executing product, service, or goods supply processes. Relevant data (Name-surname, telephone, and e-mail information) is stored in the CRM environment, exchange environment, and on company and employee phones. Persons and organizations buying tickets for more than one person will be required to commit that they have delivered this Clarification Text to the real persons whose personal data they share with us and that they have obtained and recorded their explicit consent in a provable manner.
d. Personal Data of Site Visitors: Your data consisting of IP address, start and end time of the service provided, type of service utilized, amount of data transferred, and if applicable, user ID and similar information belonging to users visiting our website is processed through our “cookies” installed on our site. We ask you to refer to our “Cookie Policy” to get more information about cookies.
e. Statistics and Profiling: We collect your personal data for business purposes through our website and applications and from open sources. For this purpose, we may process data such as your organization name, title and position, country, and participation in events. Since we anonymize the data we collect for statistics and profiling purposes, we do not store them as personal data that can be associated with you.
f. Data Processing for Communication Purposes: You can communicate with our team members and employees via e-mail, get information about future events, activities, and our services, and share your opinions and comments with us. We may process your name, surname, and e-mail address for communication purposes. Data shared via e-mails will be processed for a period of 10 years.
g. Personal Data of MindioMobile Employees: Personal data belonging to MindioMobile employees, such as name, surname, title, duty, e-mail, telephone number, visual, video recording, and voice, may be processed and shared with customers via websites or e-mail, short message, messaging software, and social media channels within the scope of the employees’ explicit consent, in order to establish customer trust, increase the efficiency of customer support services, and sustain the company’s commercial activity.
f. (sic) Personal Data of Minors under 18: We do not offer services and products aimed at those under the age of 18 at MindioMobile. For this reason, we do not keep any records regarding the ages of persons and we do not know the ages of the participants. In the event that participants under the age of 18 participate in our events of their own volition and outside our knowledge, we assume that they have obtained the approval and explicit consent of their parents or guardians for participation.
g. For Meeting Legal Obligations: We may process your personal data without seeking your “explicit consent” in cases specified in the law or as a requirement of judicial processes.
h. Creation of Contracts: We may process personal data required by the contract to be established with participants, sponsors, and our customers without relying on “explicit consent”.
7. From Whom Do We Get Support to Process Your Data? As MindioMobile, we benefit from the services offered by data processors in order to present our services to you most effectively. “Data Processor” is defined in Article 3/1-ğ of the KVKK Law as a real or legal person who processes personal data on behalf of the data controller based on the authority given by the data controller. Real and legal persons who process transactions subcontracted to them by the data processor on behalf of the data processor and the data controller are accepted as “sub-data processors”.
8. For What Purpose Do We Transfer Your Personal Data? Your personal data collected and processed in our Company in accordance with the KVKK Law is shared, within the scope of the KVKK Law and other legislation regarding the security of personal data, for the explained purposes and accompanied by confidentiality agreements, with; a) Our business partners and shareholders, b) Our suppliers providing E-mail, call center, digital event software, and SMS services, c) Our event sponsors, participating persons and organizations, d) Legally authorized public institutions and private persons, e) Our accountant, lawyer, and consultants.
9. With Whom Do We Share Your Personal Data? Your personal data consisting of the name, surname, institution, title, position in the organization, whether you are a decision-maker, and e-mail address that you provide as a participant will be shared as a list with sponsor organizations taking into account the participation and support level, and provided you give your “explicit consent”. After your data is shared with sponsor organizations, each sponsor organization will be considered a separate “data controller”. For this reason, we recommend that you apply to them to seek your rights against the transactions carried out by these companies regarding personal data – for example, to use the right to be forgotten. However, we would like to state that if you apply to us, we will forward this request to the relevant organization. Although we do not share your personal data with some sponsors, we will continue to forward messages from them to you via e-mail and SMS after the event. You can turn off message transmission from the very beginning, and subsequently, you can unsubscribe from SMS and e-mail notifications at any time, block such messages, or request to be removed from the list by applying to us.
9. (sic) Transfer of Your Personal Data Abroad As MindioMobile, all our events are international. For this reason, we heavily utilize the services of solution providers serving from abroad. In this context, your personal data is transferred to solution providers serving from abroad: a) In our digital events, your personal data is processed and stored on the infrastructure provided by IT companies offering online event management services. In the research we conducted for this purpose, we saw that the India-based HUBILO application offers the most optimum solution in terms of security and development and provides the conditions to create the digital event experience most effectively. Therefore, the data of participants who will attend digital events will be processed on HUBILO, which has the status of a “data processor” and is of Indian origin, and abroad. Since HUBILO is the platform where all digital events will be conducted, it will not be possible for us to ensure the participation of parties who do not wish to give “explicit consent” regarding the transfer of data abroad. b) To our solution partners, companies and organizations in the position of data processor and sub-data processor abroad, c) On the other hand, since we will use US-based social media applications such as Twitter, Linkedin, and Facebook for the promotion and announcement of the event, sharing your image, voice, and other personal data via these platforms is in question. d) Shared with the US-based Whatsapp (Facebook) instant messaging platform, e) Shared with e-mail services such as US-based Gmail and Russia-based Yandex. Sharing your personal data with institutions and organizations abroad will only be possible with your explicit consent. Since we need the services and applications provided by organizations abroad to carry out our digital services, if you do not want your personal data to be shared abroad with the organizations listed above, you may consider not participating in our digital events.
10. How Long Will We Store Your Personal Data? As an organization that organizes networking events and aims to bring together students, professionals, entrepreneurs, organizations, and sector leaders, we will store your personal data for a period of “five years”. Your personal data will be deleted within 6 months at the latest following the expiration of this period. However, within the scope of your right to be forgotten, you may request the deletion of your personal data earlier.
11. How Do We Protect Your Personal Data? As MindioMobile, we take all necessary technical and administrative measures under current conditions to protect your personal data and prevent it from falling into the hands of unauthorized persons, and to prevent you from being victimized for these reasons. In this framework, this is ensured by the compliance of software with standards, careful selection of third parties, examination of the privacy policies of parties to whom data is transferred, making data transfer agreements determining responsibilities with parties to whom data is transferred where possible, and compliance with our Privacy Policy within the company.
12. What Are Your Rights as a Data Subject? As the relevant person defined as the data subject by the KVKK Law, you have the following rights: a) To learn whether your personal data is processed, b) If your personal data has been processed, to request information regarding this, c) To learn the purpose of processing your personal data and whether they are used in accordance with their purpose, d) To know the third parties to whom your personal data is transferred domestically or abroad, e) To request correction of your personal data in case it is incomplete or incorrectly processed and to request notification of the transaction made within this scope to third parties to whom your personal data has been transferred, f) To request the deletion or destruction of your personal data in the event that the reasons requiring its processing disappear, despite having been processed in accordance with the provisions of the KVKK Law and other relevant laws, and to request notification of the transaction made within this scope to third parties to whom your personal data has been transferred, g) To object to the occurrence of a result against the person himself/herself by analyzing the processed data exclusively through automated systems, h) To request the compensation of the damage in case of incurring damage due to the unlawful processing of personal data.
13. How Can You Apply to Us Regarding Personal Data? As personal data owners, if you submit your requests regarding your rights listed in Article 11 of the KVKK Law to us through the methods arranged below in this Clarification Text, we will conclude your request free of charge within thirty days at the latest, depending on the nature of the application. However, in cases where a fee is foreseen by the Personal Data Protection Board, the fee in the tariff determined by our Company will be charged. Pursuant to the KVKK Law, applications regarding personal data can only be made by the data owner himself/herself. For this reason, we will only answer the part of your applications related to you. We will not be able to accept applications made about third parties such as your spouse, relative, or friend. You have the right to apply for persons under your custody and guardianship. Pursuant to paragraph 1 of Article 13 of the KVKK Law, you can submit your request regarding using your rights specified in Article 11 of the same law by using a registered electronic mail (KEP) address or the electronic mail address you have previously notified to our company and which is registered in our system, to the address [[email protected]] or in writing personally, via notary public or via registered mail with return receipt.
In the application; a) Your name, surname, and if the application is written, your signature, b) If you are a citizen of the Republic of Turkey, your T.R. identity number; if you are a foreigner, your nationality, passport number, or if available, identity number, c) Your residence or workplace address for notification, d) If available, your electronic mail address, telephone, and fax number for notification, e) Your subject of request must be present. Information and documents related to the subject should be attached to the application.
